Real Florida presence: an office in Deerfield Beach (CBS12 I-Team) with door-to-door and telemarketed sales producing complaints across Central Florida (Kissimmee/Orlando area) and South Florida (Port St. Lucie, Palm Beach County). The FL AG complaint was filed in the Ninth Judicial Circuit, Orange County.

Financing seen on their installs

Verified in Florida reporting: Dividend Solar Finance (a Fifth Third Bank company) — the FL AG received 15 complaints specifically about Dividend, and Fifth Third acknowledged a 17-state AG coalition examining Dividend's lending practices and installer relationships (CBS12, Feb 2024). One documented FL example: a $42,000 loan billing to 2047 on an inactive system.

Reported problems

Installs done without permits and panels never connected to the grid while loans started billing anyway; failed or never-completed permitting that left customers with fines and liens; roof damage; and promised savings that never appeared. FL AG specifics: FDUTPA suit filed December 2023 (announced Dec. 4, 2023) in Orange County's Ninth Judicial Circuit, citing 180+ complaints and seeking a permanent injunction plus consumer refunds. Separately, DOJ/FTC and Arizona sued in August 2023 (U.S. et al. v. Vision Solar LLC, D. Ariz., 2:23-cv-01387) alleging telemarketing-rule violations and unsubstantiated savings claims.

“But the lender already paid Vision Solar — aren't I stuck?”

1. The FTC Holder Rule notice. Many consumer loan contracts that finance a sale carry the notice the FTC requires, which states that the holder of the loan is subject to the claims and defenses the buyer could raise against the seller, with recovery capped at the amount paid. 2. The funding paperwork. Solar lenders usually release money to the installer on a completion certificate, often e-signed on a tablet. The certificate's date, and whether the system had a final inspection and permission to operate by then, are in the records.
3. Florida and federal consumer rules. FDUTPA (Florida's deceptive and unfair trade practices statute) and TILA (federal truth-in-lending disclosure rules) set out what sellers and lenders must disclose and may not do. Whether either reaches a particular sale or loan is a question for a Florida attorney.
